Best Warren Buffett Stocks For 2014

NEW YORK (TheStreet) -- The Securities and Exchange Commission on Wednesday announced that Fifth Third Bancorp (FITB) of Cincinnati and its former CFO Daniel Poston had settled charges of "improper accounting of commercial real estate loans in the midst of the financial crisis."

Fifth Third agreed to pay a $6.5 million fine, while Poston agreed to pay $100,000 and "be suspended from practicing as an accountant on behalf of any publicly traded company or other entity regulated by the SEC."

Poston had been demoted from the CFO position and named Fifth Third's "chief strategy and administrative officer in November, when Fifth Third announced its agreement to settle the charges.

The SEC accused the bank and Poston of failing to classify a pool of nonperforming commercial real estate loans as "held-for-sale" during the third quarter of 2008, even though the bank had already decided to sell the loans.  Recategorizing the loans during the third quarter of 2008 would have included a significant write down, which would have "increased Fifth Third's pretax loss for the quarter by 132 percent."

The SEC said Poston during the third quarter of 2008 was "familiar with the company's loan sale efforts, which included entering into agreements with brokers during the third quarter of 2008 to market and sell loans."  The regulatory added that "Despite understanding the relevant accounting rules, Poston failed to direct Fifth Third to classify and value the loans as required," and that the former CFO made inaccurate statements to auditors.  Poston also made inaccurate statements to Fifth Third's auditors about the company's loan classifications, and certified the company's inaccurate results for the third quarter of 2008.

Neither Fifth Third nor Poston admitted any wrongdoing.

Fifth Third's shares were down slightly during the final hour of trading Wednesday, to $19.93.

PTC (NASDAQ: PMTC  ) results for the company's Q2 have been released. For the quarter, non-GAAP revenue was just under $315 million, which bettered the $302 million the company posted in the same period the previous year. The company is facing headwinds in the broader economy. This can be seen in declining sales in many areas of their business. Regionally, the U.S was flat; Northern Europe was up; Southern Europe was down; and emerging markets were down. Autodesk also lowered quarterly and yearly revenue expectations. This lowering of guidance by Autodesk also matches the same guidance changes made by competitors Parametric Technology (PMTC) and ANSYS (ANSS), so it is not necessarily losing out to its rivals in this case.

Eagle Ford crude driller Carrizo Oil & Gas (Nasdaq: CRZO) is up nearly 14 percent since we added it to the Aggressive Portfolio on Dec. 11, and here too there was no company-specific news. Rather, Carrizo appears to have benefited from the end in mid-December of the sharp autumn correction in drillers’ share prices.

Murray Close, Warner Bros./AP From a major banking institution kicking off the new earnings season to the most-anticipated theme park debut of the year staging its grand opening, here are some things that will help shape the week that lies ahead on Wall Street. Monday -- Food for Thought The market's going to get off to a slow start on the news front. That's not a surprise given that it was closed Friday for Independence Day. One company that will be in the news on Monday is food and industrial products maker Penford (PENX). Penford's wide range of products include food ingredients, pet and animal products, sustainable bioproducts, starches for paper and packaging products and biofuels. Analysts see Penford earning 21 cents a share, but keep in mind that it has come up short against Wall Street expectations in each of the three previous quarters. Tuesday -- Harry Potter Central Florida will be a bit busier than usual on Tuesday when Comcast's (CMCSK) Universal Orlando has its grand opening of the new Diagon Alley expansion to The Wizarding World of Harry Potter. It's been a rough start. July 8 wasn't the opening date that the park originally wanted, judging by the fact that it had "The Tonight Show" and "Today" run weeklong tie-ins a few weeks ago. Conveniently for Comcast, it owns both the Universal theme parks and NBC. However, with the expansion's indoor coaster proving unreliable -- and even Universal pass holders being denied early access to attractions outside of the new Hogwarts Express train ride -- it could be an interesting debut. The crowds should be huge, the expectations lofty. Wednesday -- Mopping Up WD-40 (WDFC) reports on Wednesday afternoon. This is the company behind the multi-use lubricant. It also offers industrial cleaners, toilet sanitizers and other compounds. WD-40 didn't work out for its shareholders last time out. It posted better than expected 9 percent growth in revenue, but earnings fell just short of expectations. WD-4
